Anti-BBI Lawyer Esther Ang'awa Claims Politician has Threatened Her Life for Opposing Uhuru-Backed B

Esther Ang'awa, a Nairobi-based advocate, has taken to Twitter to protest alleged intimidation by an unnamed politician.

The advocate confided the politician took offence in her defence of the May 13 High Court ruling that annulled the Building Bridges Initiative (BBI) process.

She claimed the "aggrieved" politician used her friend to pass the message.

Whilst her position on the bill might not have augured well for some quarters, she stated that her role in the matter was purely professional and "just work for her".

"I had an interesting conversation today. A politician sent a dear friend to tell me to “leave this BBI thing, it is going to put you in a lot of trouble ahead”. I responded, “ I have heard you”. Folks, it is just work for me. You can destroy your country without threatening me," she said.

Before the BBI appeal in June, Anga'wa had been part of the battery of lawyers who successfully argued in favour of the petition challenging the bill.

Alongside Nelson Havi, Waikwa Wanyoike, Sing'oei Korir and Charles Kanjama, Ang'awa convinced the High Court to quash the constitutional amendment process, which had gained traction.

She currently runs her own practice, Ang'awa & Company Advocates with offices in Nairobi and Migori.

August 20 verdict'

Later this month, the Daniel Musinga-led Court of Appeal will deliver its judgment on the BBI appeal heard in June.

Musinga said the bench would need time to peruse through voluminous materials submitted before it by the parties in the appeal.

"We thank you for your active participation, very good preparations. You can see the volume of the documents and papers that we must plough through. We will do that and will give our judgment on August 20, at 9am," Musinga said.

The court erred

Pro-BBI lawyers led by senior counsels Otiende Amollo and James Orengo sought to convince the bench on why the May 13 ruling against the constitutional amendment could not be allowed to stand.

Otiende poked holes into the May 13 ruling that nullified the Constitutional of Kenya Amendment 2020 because President Uhuru Kenyatta unconstitutionally promoted it.

"Against all uncontroverted evidence, the promoters of this initiative were Dennis Waweru and Junet Mohamed, the court insists on finding President Uhuru Kenyatta is the promoter. Anyone can support the initiative," he explained.

On his part, senior counsel John Khaminwa who appeared for other respondents accused President Uhuru Kenyatta of disrespecting the constitution he swore to protect.

"President Kenyatta has filed an application and I’m inviting you, very respectfully, to not take note of the application… When you come to the court you must come with clean hands, the president has not come to this court with clean hands at all," he told the bench.
